BRANNON SENTENCED TO 20 YEARS FOR PUBLIC INDECENCY

On July 21, 2008, the Douglas County District Attorney’s Office prosecuted Leroy Jackson Brannon, Jr. for 4 counts of Public Indecency.

Leroy Jackson Brannon, Jr. pled guilty in front of Judge David T. Emerson on Monday, July 21, 2008 to 4 counts of Public Indecency. These charges stem from several incidents that occurred between June 16 and June 17, 2006. Brannon received a 20 year sentence which requires him to serve 10 years in prison. Brannon, who is a repeat offender, will not be eligible for early release from prison.

Assistant District Attorney Nedal Shawkat, who prosecuted the case, told the Court that Mr. Brannon was seen standing alone in his basement doorway exposing himself and performing lewd sexual acts while nude. According to evidence presented by the State, Mr. Brannon walked in and out of his house multiple times, exposing himself each time to his neighbors. The distraught neighbors called 911 and reported Mr. Brannon to the authorities. Deputy Aprile Capps of the Douglas County Sheriff’s Office responded to the scene and observed Mr. Brannon exposing himself from his basement doorway. Mr. Brannon was placed under arrest and charged with Public Indecency.

The following morning on June 17, Mr. Brannon was being held in a holding cell in the Douglas County Courthouse awaiting his bond hearing. A representative from the Public Defender’s Office entered the holding cell area and Mr. Brannon then exposed himself again.

After a person has been arrested three times for Public Indecency, the fourth offence becomes a felony. Mr. Brannon has been arrested and convicted on 6 prior occasions for Public Indecency. Therefore, he was charged with 4 felony counts of Public Indecency for this incident.

Five of Brannon’s prior public indecency convictions occurred at his home on Cowan Mill Road. In each of those incidents, Brannon was seen by neighbors exposing himself from his basement doorway. As a result, Judge Emerson banned Brannon from returning to this residence, once he is released from prison.

Assistant District Attorney Nedal Shawkat stated “that the standards of decency must be upheld in our community. Offenders who continuously ignore the law, especially with this type of lewd behavior, will not be tolerated.”
